New York’s Updated 2026 Fire Code Strengthens Safety and Opens the Door for More Clean Energy Storage

As New York continues its transition to a cleaner, more resilient energy system, one thing is clear: energy storage is essential. Batteries help keep the lights on during outages, support renewable energy deployment, and make our electric grid cleaner and more affordable.

And now, with the 2025 New York State Fire Code taking effect on January 1, 2026, communities across the state will have stronger, clearer safety standards to guide the responsible expansion of energy storage projects.

How the New Codes Was Developed

On July 28, 2023, Governor Kathy Hochul announced the creation of a New York State Inter-Agency Fire Safety Working Group to ensure the safety and security of energy storage systems across the State.

The Division of Homeland Security and Emergency Services (DHSES), Office of Fire Prevention and Control (OFPC), New York State Energy Research and Development Authority (NYSERDA), New York State Department of Environmental Conservation (DEC), Department of Public Service (DPS), and the Department of State (DOS) were directed to create a working group to independently examine energy storage facility fires and safety standards. This diverse group includes architects, engineers, firefighters, disability advocates, code officials and local government representatives. All meetings are open to the public via in person or video conferencing. 

The state found no significant adverse environmental impacts from the proposed changes, and created a Generic Environmental Impact Statement (GEIS) to give the public clear insight into the process.

Why This Update Matters for New York’s Clean Energy Transition

New York is aiming for 6,000 MW of energy storage by 2030, a cornerstone of meeting our climate goals and expanding renewable energy. But as more towns and cities consider battery storage projects, they’ve also asked for clearer statewide guidance on safely deploying this technology.

The updated fire code delivers exactly that.
